HOW MUCH IS MY PERSONAL INJURY CLAIM WORTH?
This is the magic question and there is no easy answer. The facts of every case are different and these differences can make a dramatic change in the value of each case. In personal injury claims, the issues are usually how severe and how permanent are your injures, how clear is the liability (i.e. how clearly negligent is the defendant), how much do you medical bills add up to, and how much do your lost wages add up to. The wild card is what pain and suffering and loss of enjoyment of life are you entitled to which would be determined by a jury if the case cannot be settled. Other issues which can affect the value is what is the venue (i.e. the county where your case must be tried). Jury verdicts differ depending on the county where the case must be tried. Typically this is determined by where the defendant lives. If the defendant's conduct involves DUI, hit and run, or other conduct which demonstrates a reckless disregard for human life, then your case may have additional value for punitive damages. These damages are designed to punish the defendant for severe misconduct. Adjusters often add additional value to the case based on your having legal representation because they know you will be advised as to the value of your claim and that you can litigate if they do not pay the fair amount.

HOW DO I HANDLE BY PROPERTY DAMAGE CLAIM?
The negligent driver's insurance company should pay you for the repairs of your damaged vehicle. You are allowed to select a body shop of your choice. You are also entitled to be repaid for your rental car expenses when you car is being repaired. You may also be entitled to a diminished value claim if your car has lost value due to the repairs that were done. This is usually based on the projection of how much less would your car sell for due to the body work that was done. If you car is a total loss, then the negligent driver's insurance company should pay you for the fair market value (replacement cost if you were to purchase a similar vehicle in your community). The adjuster does not have to pay off your automobile loan if your loan balance is greater than the fair market replacement cost of your vehicle. The adjuster normally will not pay for your rental car expenses after the vehicle is declared a total loss and after a total loss property damage offer is conveyed to you. WHEN DO I HAVE A VALID WORKER'S COMPENSATION CLAIM?
When you are injured by accident while working on the job doing your job duties you may have a worker's compensation claim. Your employer must have at least 3 employees and you must be an employee and not an independent contractor to have a valid claim. The Workers' Compensation Act requires that the injury must be by accident and must be in the course of and arising out of your employment for you to have a compensable claim.

WHAT BENEFITS ARE PROVIDED FOR WORKER'S COMPENSATION CLAIMS?
If you have a valid claim, then you are entitled to medical treatment with authorized doctors, income benefits (i.e. lost wage payments) if your on the job injures are causing you to be disabled from working, and permanent partial disability benefits if a doctor assigns a permanent partial disability rating.

WHICH DOCTORS CAN I GET TREATMENT FROM FOR WORKER'S COMPENSATION CLAIMS?
Authorized doctors are usually the doctors on the employer's Posted Panel Of Physicians. The employer hs the duty to post the Panel Of Physicians with at least 6 physicians and must explain its use to any injured employee. You are entitled to select a doctor from this list who becomes the authorized treating physician. You are further entitled to one free change of physician to another doctor on the Posted Panel. The employer and their worker's compensation insurance company must also pay for doctors or treatment from other doctors that the authorized treating physician refers you to. If you receive income benefits (weekly payments for lost wages), then you are also entitled to one Claimant Independent Medical Examination with a doctor of your choice. If you go to your own doctor (i.e. personal doctor, health insurance doctor, etc.), then your medical bill for this treatment will probably not have to be paid by the employer or worker's compensation insurance company.

HOW MUCH DO I GET UNDER WORKER'S COMPENSATION FOR LOST WAGES?
If you are totally disabled due to your on the job injury, and if the authorized treating physician provides you with a no work disability certificate, then you are entitled to TTD (temporary total disability) benefits. These benefits are based on your AWW (average weekly wage) which is usually calculated by your wages earned for the 13 weeks prior to the date of the accident. Your TTD (temporary total disability) comp rate is based on 2/3 of your AWW (average weekly wage) up to a maximum of $425.00. If you are working light duty and are earning less per week due to your injures, then you may be entitled to TPD (temporary partial disability) benefits. This is calculated by taking 2/3 of the difference between your current AWW (average weekly wage) each week and your AWW (average weekly wage) prior to the accident.
